EdWriting User Agreement
1. General Provisions
1.1. This User Agreement (hereinafter – Agreement) applies to the website “edwriting.com” located at https://edwriting.com/en/.
1.2. The website “edwriting.com” (hereinafter – Website) is owned by the company EdWriting Agency.
1.3. This Agreement governs the relationship between the Administration of the Website “edwriting.com” (hereinafter – Website Administration) and the User of this Website.
1.4. The Website Administration reserves the right at any time to amend, add or delete items of this Agreement without notifying the User.
1.5. The use of the Website by the User means acceptance of the Agreement and any changes made to it.
1.6. The User bears personal responsibility for checking this Agreement for changes.
2. Definitions of Terms
2.1. For the purposes of this Agreement the following terms mean:
2.1.1. “edwriting.com” – the Internet resource located at the domain name https://edwriting.com/en/, operating via the Internet resource and related services (hereinafter – Website).
2.1.2. “edwriting.com” – the site containing information about Products and/or Services and/or other values for the user, Seller and/or Service Provider, enabling content viewing, subscription to newsletters, publication of user comments on website pages.
2.1.3. Website Administration – authorized employees managing the Website, acting on behalf of EdWriting Agency.
2.1.4. Website User (hereinafter – User) – a person who has access to the Website via the Internet and uses the Website.
2.1.5. Website Content (hereinafter – Content) – protected results of intellectual activity, including literary texts, their titles, prefaces, annotations, articles, illustrations, covers, musical works with or without text, graphical, textual, photographic, derivative, composite and other works, user interfaces, visual interfaces, trademark names, logos, software programs, databases, as well as design, structure, selection, coordination, appearance, general style, and layout of such Content forming part of the Website, and other objects of intellectual property – collectively and/or individually, contained on https://edwriting.com/en/.
3. Subject-matter of the Agreement
3.1. The subject of this Agreement is the provision of access by the Website to the User for the information contained on the Website.
3.1.1. The Website provides the User with the following types of services (services):
- the possibility for the User to post messages, comments, user reviews, to rate website content;
- the possibility to upload own content (texts);the possibility to view site content.
3.1.2. This Agreement covers all existing (actually functioning) services of the Website at present time, as well as any modifications and additional services that may appear in the future.
3.2. Access to the Website is provided free of charge.
3.3. This Agreement is a public offer. By accessing the Website, the User is considered to have joined the Agreement.
3.4. The use of the materials and services of the Website is governed by the laws of Ukraine.
4. Rights and Obligations of the Parties
4.1. The Website Administration is entitled to:
4.1.1. Modify the rules of using the Website, as well as change the content of the Website. The changes take effect from the moment of publication of the new version of the Agreement on the Website.
4.2. The User is entitled to:
4.2.1. View all available content on the Website, leave comments on it, use its services.
4.2.2. Ask any questions related to services of the website via email: edward.copywrite1@gmail.com
4.2.3. Use the Website exclusively for purposes and in the manner provided by this Agreement and not prohibited by the legislation of Ukraine.
4.2.4. Copy information from the Website only if indicating an active link to the source, which is not blocked from indexing by search engines.
4.2.5. Demand from the Administration the concealment of any information about the user.
4.2.6. Use information from the website for commercial purposes without special permission – prohibited.
4.3. The User of the Website undertakes to:
4.3.1. Provide upon request of the Website Administration additional information that directly relates to the services provided by the Website.
4.3.2. Respect property and non-property rights of authors and other right-holders when using the Website.
4.3.3. Not to carry out actions that may be regarded as violating normal functioning of the Website.
4.3.4. Not to distribute via the Website any confidential or legally protected information about physical or legal persons.
4.3.5. Avoid any actions which may cause breach of confidentiality of information protected by the laws of Ukraine.
4.3.6. Not to use the Website for dissemination of advertising information without the consent of the Website Administration.
4.3.7. Not to use the services for the purpose of:
4.3.7.1. violating the rights of minors and/or harming them in any form;
4.3.7.2. infringing the rights of minorities;
4.3.7.3. representing oneself as another person or as a representative of an organization and/or community without sufficient rights, including employees of this Website;
4.3.7.4. misleading about the properties and characteristics of any content, product and/or service placed on the Website;
4.3.7.5. improper comparison of content, product and/or service, as well as creating negative attitude toward persons who do or do not use certain content, products or services;
4.3.7.6. uploading content that is illegal, violates any rights of third parties; advocates violence, cruelty, hatred and/or discrimination based on race, nationality, gender, religion, social attributes; contains false information and/or insults directed at specific persons, organisations or state bodies;
4.3.7.7. inciting unlawful actions, as well as assisting persons whose actions are aimed at violating the restrictions and prohibitions in force on the territory of Ukraine.
4.3.8. Ensure the accuracy of the information provided.
4.3.9. Ensure the security of personal data from access by third parties.
4.4. The User is prohibited from:
4.4.1. Using any devices, programs, procedures, algorithms, methods, automatic devices or equivalent manual processes to access, acquire, copy or track the Content of the Website.
4.4.2. Disrupting the proper functioning of the Website.
4.4.3. Bypassing in any way the navigation structure of the Website to obtain or attempt to obtain any information, documents or materials by any means that are not intentionally provided by the services of the Website.
4.4.4. Unauthorized access to the functions of the Website, to any other systems or networks related to the Website, as well as to any services offered on the Website.
4.4.5. Violating the security or authentication system on the Website or on any network related to the Website.
4.4.6. Performing reverse-engineering, tracking or attempting to track any information about any other User of the Website.
4.4.7. Using the Website and its Content for any purposes prohibited by the legislation of Ukraine, and/or encouraging any illegal activity or other activity that violates the rights of the Website or other persons.
5. Use of the Website
5.1. The Website and the Content included in the Website belong to and are managed by the Website Administration.
5.2. The Website Content is protected by copyright law, trademark law, as well as other intellectual property rights and unfair competition legislation.
5.3. This Agreement extends to all additional provisions and conditions for viewing content, purchasing Products and/or provision of services offered on the Website.
5.4. Information posted on the Website should not be interpreted as an amendment to this Agreement.
5.5. The Website Administration has the right at any time without notice to the User to make changes in the list of Products and services offered on the Website and/or their prices.
5.6. The document referred to in clause 5.7 of this Agreement regulates and extends its effect to the User’s use of the Website, as well as to the collection, processing and storage of his/her personal data.

5.8. The document listed in clause 5.7 of this Agreement may be updated. Changes take effect from the moment of their publication on the Website.
6. Liability
6.1. Any losses that the User may incur in case of intentional or negligent violation of any provision of this Agreement, as well as as a result of unauthorized access to another User’s communications, are not compensated by the Website Administration.
6.2. The Website Administration is not liable for:
6.2.1. Delays or failures in the process of operation caused by force majeure, and any malfunctions in telecommunications, computer, electrical and other related systems.
6.2.2. Proper functioning of the Website, if the User does not have the necessary technical means to use it, and has no obligation to provide such means.
7. Breach of the User Agreement
7.1. The Website Administration has the right to disclose information about the User if the applicable laws of Ukraine require or permit such disclosure.
7.2. The Website Administration has the right without prior notice to the User to terminate and/or block access to the Website if the User has violated this Agreement or the terms of use contained in other documents, as well as in the event of termination of the Website or due to a technical malfunction or problem.
7.3. The Website Administration is not responsible to the User or third parties for termination of access to the Website in case of the User’s breach of any provision of this Agreement or any other document containing the terms of use of the Website.
8. Dispute Resolution
8.1. In the event of any disagreements or disputes between the Parties to this Agreement, it is mandatory before going to court to submit a claim (a written proposal for voluntary dispute resolution).
8.2. The recipient of the claim shall, within 30 calendar days from the date of its receipt, notify the claimant in writing of the results of the claim’s consideration.
8.3. If it is impossible to resolve the dispute amicably, either Party has the right to apply to a court for the protection of its rights under the applicable laws of Ukraine.
8.4. Any claim relating to the terms of use of the Website must be filed within 5 days after the grounds for the claim arise, except for the protection of authors’ rights to the materials of the Website protected by law. If this condition is not met, any claim shall be dismissed by the court.
9. Additional Conditions
9.1. The Website Administration does not accept counter-offers from the User regarding changes to this User Agreement.
9.2. The User’s reviews posted on the Website are not confidential information and may be used by the Website Administration without restrictions.
